NSW Government to amend the Workers compensation legislation

The NSW Government announced today that they intend to amend the Workers compensation legislation to allow injured workers who have received lump sum compensation prior to 19 June 2012 one more chance at obtaining an increase in lump sum compensation should there condition deteriorate. This directly overturns the recent decision by the NSW Court of Appeal in Cram Fluid Power v Green.

It does not however assist those workers who received lump sum compensation after 19 June 2012, they are still only allowed to make one claim for lump sum compensation only.

This also need to be amended and no doubt there will be continued pressure on the government to allow further lump sum claims if a condition deteriorates.
