Is there a time limit for bringing a Work Injury Damages claim?

A claim for Work Injury Damages must be brought within three years from the date of your injury. If you do not bring a claim within three years you need to obtain leave to proceed out of time from the District Court of NSW. Such leave is usually obtained if there is a satisfactory reason for the delay. However, if leave is declined you can be prevented from proceeding with a claim at all. It is therefore very important to ensure that any claim for work injury damages is commenced within three years from the date of your accident.
