Total and Permanent Disability Claim – Factory Worker (NSW)

The Incident

We acted for a 45-year-old factory worker who sustained serious neck and lower back injuries while lifting heavy equipment at work.

Serious Injury and Permanent Disability

Our client underwent cervical and lumbar fusion surgery and was left with permanent restrictions preventing a return to manual work.

Claim Rejected by the Insurer

The insurer initially declined the claim due to inadequate supporting evidence lodged prior to our involvement.

Legal Support and Advocacy

Led by Kerry Byrnes, Accredited Specialist in Personal Injury Law, we obtained detailed medical and vocational evidence to address permanent incapacity.

Outcome

Following submission of further material, the insurer accepted the claim and paid the TPD benefit in full.
