Workers Compensation – Concrete Pour $925,000 Heavy Concrete Line Injury Claim (NSW)

The Incident

We were instructed by Anthony, a construction worker who was carrying out a concrete pour using heavy concrete pumping lines. The work required Anthony to repeatedly lift, hold and manoeuvre the concrete line while it was under significant weight and pressure. During the pour, he suffered serious injuries.

Serious Injury and Medical Treatment

Anthony sustained a lumbar spine injury involving disc damage and nerve symptoms, together with injuries to his shoulder and upper limb. He experienced ongoing lower back pain, restricted movement and difficulty bending, lifting, reaching and carrying. These restrictions were particularly significant given the heavy and repetitive nature of his construction work.

The Long Road to Recovery

Anthony underwent treatment and rehabilitation but continued to experience symptoms that prevented him from returning to his previous duties at full capacity. Working with concrete lines requires strength, balance and the ability to respond safely when the line moves or changes direction. Anthony’s ongoing symptoms meant that returning to this type of work presented significant difficulties. His injury affected not only his employment but also his ability to perform household tasks, exercise and participate comfortably in everyday activities.

Why Specialist Legal Advice Was Required

Anthony’s claim required consideration of the way the concrete pour was conducted and whether appropriate equipment, staffing and assistance were available to safely handle the heavy concrete lines. Specialist medical evidence was also needed to establish the permanent effect of his injuries and the financial consequences of his reduced ability to undertake heavy construction work.

Legal Support and Advocacy

Garling&Co gathered medical evidence addressing Anthony’s spinal, shoulder and upper-limb symptoms and documented the physical requirements of his pre-injury role. We also considered his future employment options and the effect his restrictions would have on his ability to compete for construction and other manual roles.

Securing a Life-Changing Outcome

Anthony’s matter resolved for $925,000 in compensation. The settlement recognised the lasting impact of the accident on his physical capacity and working life and provided financial security while he continued treatment and considered his future employment options.

Our Commitment

At Garling&Co, we are committed to supporting clients through the impact of serious workplace injuries. We provide the expert legal assistance our clients need to reset, reclaim and rebuild their lives.
