Workers Compensation – Construction Worker $850,000 Heavy Steel Beam Injury Claim (NSW)

The Incident

We were instructed by Daniel, a construction worker who was required to manually lift and manoeuvre heavy steel beams without mechanical lifting assistance. While handling one of the beams, Daniel suffered a serious injury.

Serious Injury and Medical Treatment

Daniel sustained a significant lumbar spine injury with disc damage and nerve symptoms extending into his leg, together with a shoulder injury caused by the force involved in lifting and controlling the heavy steel. His injuries caused persistent lower back pain, restricted movement and difficulty lifting, bending, carrying and remaining in one position for extended periods.

The Long Road to Recovery

Daniel had spent much of his working life in physically demanding construction roles. Following the injury, the movements fundamental to his occupation became the very activities he struggled to perform. Although he underwent treatment and rehabilitation, he was left with ongoing restrictions that substantially reduced his ability to undertake heavy manual work. This created considerable uncertainty about his future employment and earning capacity.

Why Specialist Legal Advice Was Required

The claim required careful examination of the system of work and whether appropriate mechanical lifting equipment or other assistance should have been provided for the task. Medical and occupational evidence was also required to demonstrate why Daniel’s restrictions represented a significant disadvantage in the construction industry, even if he retained some theoretical capacity for lighter work.

Legal Support and Advocacy

Garling&Co obtained specialist evidence addressing Daniel’s spinal and shoulder injuries, treatment requirements and future work capacity. We also documented his employment history and the practical difficulties he faced in finding sustainable alternative employment within his physical restrictions.

Securing a Life-Changing Outcome

The matter resolved for $850,000 in compensation. The outcome recognised the substantial effect the workplace injury had on Daniel’s ability to continue in physically demanding employment and provided greater financial certainty while he considered rehabilitation and alternative work.

Our Commitment

At Garling&Co, we are committed to supporting clients through the impact of serious workplace injuries. We provide the expert legal assistance our clients need to reset, reclaim and rebuild their lives.
