What is whiplash injury?

A whiplash injury is another name for neck strain or muscular damage.

Whiplash is usually associated with a car accident which caused the head to be jerked forward or backward suddenly causing injury to the muscles of the neck.

The sudden force tears and injures the muscles and tendons in the neck. Such an injury can also be used to describe any injury to the spine including the lower back. It is most commonly found however in the neck. Most people who sustain a whiplash injury in car accidents recover within a few days or weeks and have no ongoing symptoms, however sometimes the symptoms can be hard to treat and become chronic.

How do I know if I have whiplash injuries?

Symptoms of whiplash may include:

  • Pain and tightness in the neck
  • A decreased range of motion when moving the head from side to side
  • Tenderness to touch
  • Headaches

Sometimes symptoms can appear immediately following a car accident and other times it may take several hours or days before the neck begins to hurt.

Whiplash injuries can be serious and interrupt with the persons every day activities including the ability to work. Often these types of injuries make it difficult to sit or stand still in any one place for any length of time. This can affect the ability to work particularly if you sit in front of a computer all day.

Are there time limits when it comes to making a whiplash injury claim?

Yes. There are strict time limits in which you are able to bring about a claim for compensation. These vary from state to state so it is very important you seek legal help right away.

The time limit can be much shorter for certain claims so we recommend you seek legal advice straight away following an accident.

If you believe you have sustained a whiplash injury in a car accident, you should consult your general practitioner for treatment.

You should also consider making a claim for whiplash injury compensation under the Motor Accidents Compensation Act in NSW. You will be eligible to make a claim for the cost of any medical treatment and loss of income and also possible pain and suffering compensation.
